General Terms and Conditions
of sales
1- SCOPE OF APPLICATION
These general terms and conditions of sale outline the rights and obligations of Cycles Cadence and its Client within the framework of the sale of custom-made bicycles and frame kits. Before confirming any order, the Client must review and accept the general terms and conditions of sale.
Cycles Cadence reserves the right to adapt or modify these general terms and conditions of sale at any time. In case of modification, the terms applicable to each order will be those in effect on the date of the order.
2- PRODUCT INFORMATION
The photographs and/or drawings illustrating the products (complete bicycle and frame kit) are provided for indicative purposes and do not constitute part of the contract, unless otherwise specified on the product sheet. The images of the products presented on the site may differ from reality due to their specific and unique manufacturing.
Cycles Cadence cannot be held responsible if the information is inaccurate or incomplete. The Client is therefore invited to refer to the description of each product to understand its properties and specifics.
3- PRICES
Prices are expressed in euros, including all taxes. The final total price may change during the creation of the bicycle following one or more additional requests made by the Client to Cycles Cadence. In this case, an updated quote will be sent to the Client. If shipping costs apply, they will be included in the total price.
4- ORDER (TERMS)
Every order must be preceded by a quote provided by Cycles Cadence to the Client. The sale is concluded only upon return of the signed "bon pour accord" quote from the Client to Cycles Cadence, and upon receipt of the deposit for the order by Cycles Cadence, and subject to the availability of the necessary components to complete the order.
In case of unavailability of a necessary component for the order, Cycles Cadence reserves the right to offer the Client an equivalent or superior component. If none of the replacement solutions satisfy the Client, the order for the concerned component can be wholly or partially canceled at Cycles Cadence’s discretion, and the corresponding amount will be refunded to the Client without any claims for damages.
Cycles Cadence reserves the right to cancel any order from a Client with whom there is an ongoing dispute concerning the payment of any part of the order or a previous order. The information provided by the buyer when placing the order is binding. In case of error in the recipient's address, the seller cannot be held responsible for the inability to deliver the product.
5- PAYMENT
The price charged to the Client is the price indicated on the latest quote sent by Cycles Cadence. It is payable according to the conditions specified in the quote. These conditions generally include a deposit upon order and the balance to be paid before delivery. Payments can be made by bank transfer or check.
For deliveries outside mainland France, the Client agrees to pay all taxes due on importing products, customs duties, value-added tax, and all other taxes payable under the laws of the country where the order is received. Cycles Cadence disclaims all responsibility if the Client fails to pay these taxes. The order validated by the Client will only be considered effective once payment is received by Cycles Cadence.
6- DEADLINES
Cycles Cadence provides deadlines as an indication. Any delays do not entitle the Client to compensation, price reduction, or order cancellation. No invoice withholding can be made by the Client, whether for a delay issue or any other reason, except in cases of applicable legal provisions.
7- DELIVERY
Products are delivered to the delivery address indicated on the Client's invoice. Our products travel at the recipient’s risk. The inspection of delivered goods must occur at the time of product receipt. It is the recipient’s responsibility to make necessary reservations to the carrier within 3 days of receipt, in accordance with article L 133-3 of the Commercial Code.
Without prejudice to actions against the carrier, the Client must inform Cycles Cadence by registered letter with acknowledgment of receipt within 3 days of delivery of any apparent defects or non-conformity of the delivered goods.
8- RIGHT OF WITHDRAWAL
No custom-made product specifically for the Client can be subject to a right of withdrawal.
For other products, in accordance with article L.121-21 of the Consumer Code, you have a 14-day withdrawal period from receipt of your products to exercise your right of withdrawal without having to justify reasons or pay penalties.
Returns must be made in their original state and complete. In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may defeat the right of withdrawal. Return costs are at your expense.
In the event of exercising the right of withdrawal, Cycles Cadence will refund the amounts paid within 14 days following notification of your request and using the same payment method as used for the order.
9- WARRANTIES
Cycles Cadence frames are lifetime guaranteed, the paint for 2 years, and the peripherals for 2 years. The warranty covers hidden material or manufacturing defects. Our warranty obligation is expressly limited to the repair or replacement of the recognized defective part, with transport costs remaining the responsibility of the buyer.
The warranty does not apply to replacements or repairs resulting from normal wear, deterioration, or accidents due to defective assembly, lack of maintenance, or use of the equipment under conditions for which it was not intended. It is non-transferable and only covers the first buyer.
10- LIABILITY
Cycles Cadence cannot be held responsible for damages of any kind, whether material, immaterial, or bodily, that may result from the malfunction or misuse of the marketed products. Consequently, Cycles Cadence recommends that users strictly comply with the use of the equipment under the conditions for which it was intended.
11- PERSONAL DATA
When placing your order, Cycles Cadence reserves the right to collect personal information and data concerning you. Cycles Cadence undertakes not to communicate, for free or with consideration, the data of its customers to a third party, except with the customer's consent.
In accordance with the “Informatique et Libertés” law, the customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification, and deletion of the data concerning them, which they can exercise with Cycles Cadence.
12- INTELLECTUAL PROPERTY
The content of the website cycles-cadence.fr (images, videos, texts, logo, etc.), documents provided and transmitted to Clients, or generally any information subject to intellectual property rights, remain the exclusive property of Cycles Cadence. The contents are protected by French and international copyright and intellectual property laws. Any total or partial reproduction, modification, or use of these materials for any reason is strictly prohibited unless explicitly authorized in writing by Cycles Cadence.
13- DISPUTE RESOLUTION AND APPLICABLE LAW
These terms of sale are subject to French law. In case of dispute, and failing an amicable agreement, the competent court will be that of the location of the seller's registered office.
